HIV infector 'may change plea'


The New South Wales Director of Public Prosecutions (DPP) will be asked to consider an alternative charge for a man who pleaded guilty to infecting his former wife with HIV.

Brian James Montgomery, 37, fronted Penrith District Court for sentencing today, after earlier pleading guilty to causing his former wife to contract a grievous bodily disease sometime between January 1994 and December 2003.

The court heard he refused to wear a condom when having sex with her, despite being aware he carried HIV.

One of the couple's three children was born with HIV and died from an AIDS-related illness.

Judge Bennett adjourned the matter after Brian Mongomery's lawyer said his client is considering changing his plea.

The case has been adjourned until October 17.

Brian Montgomery remains on bail.
