Man with HIV escapes jail time after having unprotected sex

A Melbourne man who had unprotected sex with a woman without telling her he had HIV has escaped an immediate jail term.

Lam Kuoth, 29, pleaded guilty to two counts of reckless conduct endangering another person.

He met a 24-year-old woman at a Prahran nightclub last year and had unprotected sex with her.

The County Court heard Kuoth did not infect her with HIV, but was aware that he could have done so.

The court was told the community had sympathy for those infected with HIV but expects those people to behave in a way that does not affect public health.

Kuoth is under a supervision order imposed by the Department of Human Services with further conditions imposed by the court.

He has been sentenced to two years' prison, suspended for three years.
